Public Consultations

Tarion's Regulatory Affairs Committee approved a public consultation process for proposed policy changes that are on the Board of Directors' Annual Regulatory Plan.  This Annual Regulatory Plan was approved by the Board of Directors on January 27, 2011.  When a proposed policy change is defined, Tarion will post draft materials and background information on this page for your comment.

A Review of Rules for Builder Arbitration Forum (BAF) 

On December 8, 2011, Tarion’s Board of Directors approved the following Discussion Paper for the purpose of circulating to stakeholders and receiving input on proposed changes to Tarion’s BAF process.
 
 
 Ø Some preliminary suggestions for changes that have been outlined in this paper are as follows:
 
- “Fast Track” process
- End publication of BAF decisions
- Fewer lawyers
- Reduction of costs
- Allow for deposit and financial loss claims in BAF process
- Different processes for warrantability vs chargeability

Seeking Feedback on 1st Edition of Construction Performance Guidelines for Common Elements 

On December 7, Tarion launched a public consultation process to seek input on the proposed 1st Edition of the Construction Performance Guidelines for Common Elements in Condominium Projects (CE CPG).
 
The CE CPG is a newly-created reference guide, intended to identify and provide more clarity to the most common issues encountered during the common elements claims process. For more details regarding this proposed publication, please read the Backgrounder.

A Review of Delayed Closing/Delayed Occupancy Addenda 

On October 6, 2011, Tarion’s Board of Directors approved the following documents, for the purpose of informing and obtaining feedback from our key stakeholders on proposed changes to Tarion’s Delayed Closing/Delayed Occupancy Addenda. The formal consultation period ended on November 25, 2011.  Updates regarding final regulation changes and policy decisions, related to this review, will be posted on this site in early 2012.
 
·         Backgrounder: 
Ø  Management has recommended certain changes including:
o    new flexibility to amend Critical Dates by mutual agreement;
o    a special form for freehold homes linked to common element condominiums; and
o    better disclosure of closing adjustments.
(see Section 4 of Backgrounder for more details on these and other management recommended changes.)
 
Ø  Section 5 of the Backgrounder outlines suggested changes that have not been recommended by Tarion’s management.
 
 

Regulation under Consultation 

The proposed Major Structural Defect (MSD) policy is still under review. The anticipated July 1, 2011 implementation date has been delayed. Further updates on timing and process will be available here in the months to come.
