New Home Builders
Image: New Home Builders Under the Ontario New Home Warranties Plan Act, builders and vendors have a number of obligations to fulfill to legally build and sell new homes in Ontario. This section will help builders and vendors understand their mandatory responsibilities under the Act.

All builders and vendors must be registered with Tarion to build and sell homes legally in Ontario. In addition, all new homes must be enrolled prior to construction.

As a new home builder or vendor, you are required to provide warranty protection to your customers. Quality after sales service is the foundation on which your reputation as a builder or vendor is built. Today’s consumer demands timely and effective service should a warranty issue arise.

Customer Service Standard
Since the introduction of the Customer Service Standard (CSS) in 2003, Tarion has had the opportunity to speak with builders and consumers about their experiences with these policies.

 

Based on this feedback, along with our own experience administering the Customer Service Standard, we have made some refinements to these policies. Builder Bulletin 42 was issued in March 2009 and replaces Bulletin 42 (Revised) which was issued in July 2005. This Bulletin restates the Customer Service Standard and incorporates certain changes based on the ongoing review of its application by Tarion.  It includes information about:

  • The Homeowner Information Package;
  • The Pre-Delivery Inspection;
  • The Statutory Warranty Claims Process;
  • Warranty Reviews (Builder-requested conciliations)

This Bulletin is effective for all freehold homes and condominiums with a date of possession on or after October 1, 2003. Certain changes only apply to homes with a date of possession on or after September 1, 2005.
