Builder Arbitration Forum

As of April 2, 2003, a builder who disagrees with the findings of a Tarion Report – specifically whether an item is warrantable or a conciliation is chargeable – can dispute the findings at the Builder Arbitration Forum.

Historically, a builder who disagreed with a Conciliation Report would have asked a Warranty Services Manager to conduct an informal review. If the informal review confirmed the findings in the report, the builder’s only recourse was to refuse to perform that work and have Tarion issue a Notice of Proposal (NOP) to revoke the builder’s registration.

To address this situation, a sub-committee comprised of members of Tarion and the Ontario Home Builders’ Association (OHBA) recommended the establishment of a Builder Arbitration Forum, where a Tarion Report that has been challenged can be reviewed before an independent arbitrator in a manner that is timely and impartial.
