Special Requirements for Condominium Construction

If you are building residential condominiums in Ontario, you may be required to attend an interview with a Tarion representative. You may also be required to pass a test to determine your level of technical knowledge and skill in construction.

If you are planning to build a high-rise condominium project (any project which falls under Part 3 of the Ontario Building Code), you must comply with the design and site review requirements of Builder Bulletin 19.

If you are planning to build a low-rise condominium project, and it includes elements which fall under Part 3 of the Ontario Building Code, it may be designated, at the Registrar’s discretion, as a Modified Builder Bulletin 19 project. In this case, you will be required to submit a modified form of design and site review report described in Builder Bulletin 19. The Process
  1. All condominium builders are required to complete a Condominium General Review Form. You can request a copy of the form by calling  the Tarion Customer Centre at 1-877-9TARION (1-877-982-7466). 
  2. Once Tarion has received your completed form, a representative from our Condominium Office will contact you to verify the information and to answer any questions you may have about the process.
  3. After you submit the form, and your risk assessment is completed, you will be advised of the security requirements for the project. Security must be posted prior to registration and/or the taking of deposits and the execution of Agreements of Purchase and Sale.
  4. Condominium units and common elements must be enrolled at least 30 days prior to commencement of construction. A Condominium Enrolment Form may be requested from the Licensing & Underwriting Department at Tarion.
  5. Return the enrolment form along with the appropriate fee to:

  6. You can determine the fee by viewing the enrolment fee table (please include PST and GST). Cheques should be made payable to “Tarion Warranty Corporation”.
  7. Send the original copy of the Condominium Enrolment Form to Tarion and retain the second copy for your records.
  8. A preprinted Certificate of Completion and Possession (with attached Warranty Certificate) will be sent to you for each unit you enrol in addition to the common elements as confirmation of enrolment. You will also be sent a copy of the Deposit Receipt for each unit after it has been enrolled and standard security has been provided to Tarion. If you require additional Deposit Receipts, contact the Licensing & Underwriting Department at Tarion.
