 Site Posting of Enrolment

 
Effective October 1, 2008, residential home builders will be required to display or make available for review at every job site, an Enrolment Notice supplied by Tarion. This Bulletin sets out the guidelines for the content and use of the Enrolment Notice.

Condominium Delayed Occupancy Warranty

 

This Bulletin introduces a change to the Delayed Occupancy Warranty policy for Condominiums and supersedes Builder Bulletin 25 (Revised). This Bulletin applies to most purchase agreements dated on or after July 1, 2008. Note: if one purchase agreement in a condominium project (or a phase of a phased condominium) is signed before July 1, 2008, then the entire project is subject to the old Delayed Occupancy policy. Please refer to Builder Bulletin 25 (Revised) for those guidelines.

Aggregate Maximum Coverage Amount Increase for One Year, Two Year and Major Structural Defect Warranties

 

This Bulletin introduces a change to the warranty coverage provided to homeowners under the Ontario New Home Warranties Plan Act (the “Act”), effective for homes with a date of possession on or after

July 1, 2006.

Waiver of Indemnity from Builders

 

Tarion is entitled to recover from builders amounts paid out of the Guarantee Fund in respect of warranted claims made by homeowners.  In certain circumstances where a claim has been originally deemed “not warranted” by Tarion but the Licence Appeal Tribunal reverses Tarion’s finding and holds that the item is warranted, the Registrar has the discretion to waive Tarion’s statutory and contractual rights of indemnity against a builder. This Bulletin sets out the guidelines under which Tarion’s Registrar shall exercise his or her discretion in such cases.

Escalating Consequences

This Bulletin provides details of the repercussions for builders who fail to comply with the minimum new Customer Service Standard under the terms of Builder Bulletin 42 (see below). This Bulletin takes effect on October 1, 2004.

Customer Service Standard

 

This Bulletin was issued in July 2005 and replaces Bulletin 42 (Revised) which was issued on March 15, 2004. This Bulletin restates the Customer Service Standard and incorporates certain changes based on the ongoing review of its application by Tarion.  It includes information about:

 

  • The Homeowner Information Package;
  •  The Pre-Delivery Inspection
  •  The Statutory Warranty Claims Process
  • Warranty Reviews (Builder-requested conciliations) 

 

This Bulletin is effective for all freehold homes and condominiums with a date of possession on or after October 1, 2003. Certain changes only apply to homes with a date of possession on or after September 1, 2005.

Outlines construction performance standards for the most common work and material claims that the Warranty Program currently receives.  The Guidelines are used by Warranty Services Representatives in rendering decisions on items in dispute by builders and consumers (effective December 1, 2003).
