According to the Ontario New Home Warranties Plan Act, the Registrar has the power to refuse a builder or vendor’s application for registration or renewal with Tarion Warranty Corporation, and to suspend or revoke a builder or vendor’s registration to build and sell new homes in Ontario.

The Registrar may choose to take such action for a number of reasons, including a high ratio of chargeable conciliations and/or claims, failure to provide financial information to Tarion, and failure to provide security.

From April 1 to June 30, 2008 Tarion refused, revoked or suspended the registration of the following 28 builders and/or vendors:

George Snizer and Ana Daviana Schnitzer had their application for registration refused for failing to execute and deliver the document detailing specific Terms and Conditions of Registration.

Christopher Giansante, Brian Giansante, Filippo Giansante (ex-reference number 37586) of Tecumseh
registered since March 12, 2008, had their registration revoked due to: failure to provide security; issuing
a cheque to Tarion and subsequently placing a stop payment on it; failing to enrol in a timely manner.

Incredible Homes Inc. (ex-reference number 37245) of Toronto, registered since March 6, 2007, had its renewal of registration refused due to: insufficient equity; poor commercial credit rating; failure to execute and return the standard Indemnity Agreement.

Dany DeCamillis had his application for registration refused due to: insufficient equity; scoring ‘below average’ in an interview and written examination on technical competence.

Anthony Giorno had his application for registration refused due to the following: failure to pay enrolment fee; failure to provide supporting documents for the Personal Net Worth Statement of its Indemnitor; failure to provide security;
failure to sign and return the standard Indemnity agreement; failure to sign and return the standard Vendor and Builder Agreements; failure to enroll; acting as a vendor and/or builder without being registered; failure to attend an interview and written examination on technical competence; failure to provide a reference letter from his financial institution; failure to inform Tarion of proposed construction plans; failure to have someone witness the signing of the application for registration form.

T. R. Renovations Ltd. had its application for registration refused due to: failure to enroll in a timely manner; failure to attend an interview and written examination on technical competence; acting as a Vendor and/or Builder without being registered.

Radu I. Segal had his application for registration refused due to: insufficient equity; failure to pay enrolment fee; failure to enroll; failure to sign and return the standard Indemnity agreement.
