Understanding Deposit Protection

Tarion protects deposits for new freehold homes and condominium units if the builder does not complete the sale, through no fault of your own. Your deposit is protected from the moment it is paid.

Deposits on freehold homes are protected up to $40,000 if the purchase agreement or construction contract was signed on or after February 1, 2003, or up to $20,000 if the purchase agreement or construction contract was signed before Febuary 1, 2003. 

Deposits for condominium units are protected up to $20,000 (plus interest required by the Condominium Act). Condominium purchasers are protected for deposits over $20,000 by the trust and excess deposit provisions of the Condominium Act, 1998.

Tarion does not protect deposits you make with the intention of reserving or holding a home or condominium unit before you enter into an agreement to purchase that property. It is recommended that you not give your builder a large sum of money to ‘hold’ a home for you. Ask that any money you give be held in trust and obtain a receipt.
Making a Claim for Deposit Refund
  1. Mail or fax your claim in writing to the Tarion corporate office, along with a copy of the first page of your Agreement of Purchase and Sale.
  2. Once Tarion has received your information, you will be sent a deposit claim form.
  3. You will then be required to provide a copy of your cancelled deposit cheque.
