The North Bay Nugget reported that new home builder Roland Boissonneault was returned to jail after a judge refused to grant him a new trial or overturn his latest conviction.
Justice Duchesneau-McLachlan upheld an earlier ruling, which sentenced Boissonneault to jail for six months and ordered him to pay $20,000 in fines for illegal building. In Ontario, illegal building occurs when a new home builder fails to register and enrol their new homes with Tarion Warranty Corporation.
Boissonneault is only the third builder in the province to go to jail for this crime. The jail time, combined with his fines, makes this the harshest sentence ever given to an illegal builder in Ontario. Boissonneault has previous convictions dating back to 1997 and his latest charges date back to May, 2001 and involve homes in five different communities.
Carol Street, the prosecutor in the appeal case, called Boissonneault the “worst” of the illegal builders she has prosecuted in the past twenty years.
