This publication provides a general overview of warranty coverage and procedures under the Ontario New Home Warranty Plan, created under the Ontario New Home Warranty Plan Act (the ONHWP "Act"). If there is any conflict or inconsistency between this publication and the ONHWP Act (including its regulations), the ONHWP Act prevails. Contains Important Statutory Warranty Information
Getting ready to move into a new home is an exciting and busy time. However, it is important that new home buyers set aside some of that time to carefully read through the Homeowner Information Package and become familiar with its contents, which describe:
- The statutory warranties that apply to all new freehold and condominium units built in Ontario
- The responsibilities of homeowners, builders and Tarion
- The process used by Tarion to handle statutory warranty claims
When making a statutory warranty claim, homeowners are responsible for completing all Statutory Warranty Forms and submitting them to Tarion within specific time periods (described in the Homeowner Information Package). Copies of all Forms should also be sent to the builder. Failure to properly submit Forms could jeopardize a homeowner's rights under the Ontario New Home Warranties Plan Act.
