If you are building your own home in one of the municipalities listed below, you are required to obtain a Letter of Confirmation prior to obtaining a building permit:
The purpose of obtaining a Letter of Confirmation is to protect new home buyers from potentially entering into a contract with an illegal builder.
All builders in Ontario must provide a seven year statutory warranty on every home they build. Click here to find out more about the new home warranty.
If a homeowner builds his/her own home, the home is exempt from the warranty. This means that by building your own home, you are responsible for defects in construction that may arise when building your own home. Owner-builders are not required to register with Tarion. However, before obtaining a building permit, they must receive a Letter of Confirmation from Tarion.
A Letter of Confirmation is required when building a new home prior to obtaining a building permit in the following circumstances:
Note: An owner-built home is NOT a contract home constructed under a contract between a builder and an owner of land where the builder provides for the construction of a home on the land. Check the Ontario Builder Directory to ensure your builder is registered with Tarion before you enter into an agreement with a builder. You can also contact Tarion to ensure your new home is enrolled in the warranty program.

An owner-builder must first receive a Letter of Confirmation from Tarion before obtaining a building permit.
Once the home is built, if the owner sells the home without first legitimately residing in the home, he or she must register with Tarion. Further, the owner will be responsible for warranty coverage on the home. If the owner fails to register with Tarion and enrol the home before the home is sold, the owner may be subject to prosecution and face significant fines and/or imprisonment.
