Under the Act, Tarion is able to become involved in a claim only at the homeowner’s request, so be sure to file your Statutory Warranty Forms on time.
Late forms are not accepted – which means unless a warranty form is received by its deadline, Tarion cannot intervene.
When considering whether to submit a Statutory Warranty Form, refer to your PDI Form or purchase agreement to determine whether any items remain outstanding or unresolved. If you are in doubt as to whether an outstanding item is covered by your home’s statutory warranty, you can refer to Tarion’s Construction Performance Guidelines which outline what does and does not represent a warrantable defect for almost 300 items.
