Toronto – Muhammad Nadeem Akram and Ayesha Nadeem have been convicted of illegal vending for selling a home without being registered under the Ontario New Home Warranties Plan Act. The couple was fined $10,000 by the Ontario Court of Justice.
The conviction came as a result of a complaint from a homeowner regarding their home located at 178 Reiner Road in the city of Toronto. The home was new and had not been previously occupied when it was sold to them.
Under the Ontario New Home Warranties Plan Act, new home builders and vendors must be registered with Tarion and enroll their homes in the new home warranty program. Most new homes are entitled to warranty coverage if they have been unoccupied prior to sale or are less than seven years old.
In response to the complaint, Tarion’s investigation revealed that Muhammad Nadeem Akram and Ayesha Nadeem were not registered and the home at 178 Reiner Road had not been enrolled in the warranty program.
In August 2018, Tarion charged Muhammad Nadeem Akram and Ayesha Nadeem under the Ontario New Home Warranties Plan Act with not being registered as vendors. The two pleaded guilty to the charges. On June 24, the presiding Justice of the Peace, Justice Brihmi accepted their guilty pleas and levied a fine of $8,000 in addition to victim surcharge fees, for a total of $10,000.
The Ontario New Home Warranties Plan Act protects the rights of home buyers. Builders or vendors who violate the Act can be prosecuted.
