What Real Estate Professionals Need to Know about Tarion

Whether you’re helping your clients purchase a new home or condo, or a resale one, it’s important that you understand the statutory warranty that comes with almost every newly built home and lasts for seven years.

By law, all new homes in Ontario built by a licensed vendor or builder come with a statutory warranty under the Ontario New Home Warranties Plan Act (ONHWPA).

Tarion ensures new home buyers receive the statutory warranty coverage they are entitled to under the Act. This statutory warranty protection follows the home and is valid for seven years from the original date of possession, regardless of who owns the home.

That means, if you are involved with the purchase or sale of a home that is less than seven years old, it should come with a Tarion-backed warranty.

Ontario Builder Directory

Effective February 1, 2021, the Home Construction Regulatory Authority (the HCRA) has been designated as Ontario’s regulator of new home builders and vendors under the New Home Construction Licensing Act 2017 (NHCLA).  

The HCRA will be responsible for: 

•    Licensing new home builders and vendors; 
•    Enforcing high professional standards for competence and conduct; 
•    Investigating illegal building practices; and, 
•    Administering the Ontario Builder Directory.

If you wish to confirm whether a home is enrolled in the warranty program or whether a builder is licensed, you can visit the HCRA’s Ontario Builder Directory.  You can also report any suspected illegal building or builder conduct issues by contacting the HCRA and following their complaints process.
