The holey drawer: Warranted or not warranted?

New home owners, Stella and Terry (not their real names) purchased a newly built home. They were mostly happy with their home since they were able to pick the layout, choose the finishes of their kitchen cabinets, and even select paint colours for their walls.

What they didn’t get to choose was where certain essential functioning parts of the home would be located, such as water pipes or, in this case, a gas valve.

Stella and Terry noticed that the builder cut into the bottom of the gable below the drawer where they kept their pots and pans, to provide access to the gas shut off valve. Their claim was that when they pulled the cabinet drawer open, the cut-out was visible and they felt that the gas valve location was not accessible.

When the couple advised their builder of this concern, the builder came to check it out and disagreed. That’s when Stella and Terry contacted Tarion to help assess if it would be covered under the warranty.
