A “builder” is a person who undertakes the performance of all the work and supply of all the materials necessary to construct a completed home whether for the purpose of sale by the person or under a contract with a vendor or owner.

A “vendor” is a person who sells on his/her own behalf a home not previously occupied to an owner.

A person can register with Tarion as a builder, as a vendor or as both a vendor and a builder. To build a new home, a person must be registered as a builder. To sell a new home, a person must be registered as a vendor.

When you see the name of a builder / vendor that is made up of a number, such as "1234567 Ontario Inc, this is a numbered company name. Many businesses include numbered company names, which are legal businesses in Ontario.

An Umbrella Group is a group of builders/vendors sharing at least one common officer, director, principal or partner. The Umbrella Group itself is not a legal entity and does not have its own registration number, but each member company of the Umbrella Group is a separate legal entity and has its own registration number.

The list of member companies comprising an Umbrella Group is based upon information provided by the builder/vendor with its application for registration or renewal. Tarion does not independently verify this information and is not responsible for ensuring the accuracy of this information.

The location refers to a city or town where a builder/vendor has constructed and/or sold new homes.

A home’s enrolment date is the date when the home was enrolled with Tarion..

City refers to the municipality (e.g. city, town) in which the enrolled home is located.

A home’s lot number is part of the legal description of that home assigned by the municipality in which it is located.

You may find it helpful to search by Lot or Plan Number if your home has not yet been assigned a municipal street address.

In the case of a freehold home, the warranty start date is the date when the purchaser takes possession of the home. In the case of a condominium unit, the warranty start date is the date when the purchaser takes occupancy of the unit.

The warranty end date is the date when the seven-year warranty coverage on the home ends. Please note that the warranty consists of one, two and seven-year coverage, as outlined here.

Freehold: When a freehold home is purchased, the purchaser agrees to buy both a parcel of land and a residential dwelling unit to be constructed on that parcel of land. Various types of dwellings fit this category, including a single family detached home, a semi-detached home, a unit in a row house or a unit in a duplex.

Condominium: When a condominium unit is purchased, the purchaser agrees to buy a residential dwelling unit within a condominium project containing multiple units and shared areas and/or amenities, referred to as common elements. Various types of dwellings fit this category, including a unit in a high-rise, mid-rise, or low-rise building, a unit in a row house, or a fully detached home.

The Conviction Date is the date the defendant was found guilty of the charge against them.

The Defendant is the company or individual charged by Tarion with an offence under the Ontario New Home Warranties Plan Act (ONHWPA) or the Provincial Offences Act (POA).

Defendant Location refers to the city associated with the defendant's address at the time the charge was laid against them.

Offence Location refers to the city in which the offence took place.

Tarion can lay charges under the Ontario New Home Warranties Plan Act (ONHWPA) or the Provincial Offences Act (POA). The Charge column shows the specific offence (section) under which a defendant was charged and convicted.

A conviction is a formal declaration by the courts that a defendant is guilty of an offence. Conviction Results listed in this column may include a fine (monetary penalty), a term of incarceration (a sentence of detention resulting from a conviction), or a suspended sentence (a registered conviction with no associated monetary penalty or incarceration).

This column indicates the monetary penalty handed down by the courts in connection with a conviction. The Fine Amount is calculated as a sum total of the fine imposed by the courts, plus any victim fine surcharge (VFS) amount levied with the conviction.

The VFS amount is a fee collected by the courts and deposited into a special fund to assist victims of crime. If the value in the Fine Amount column is zero, it means that no monetary penalty was levied by the courts in association with the conviction.

If a Yes is shown in the Under Appeal column, it means that the defendant has formally registered an appeal with the courts to contest a sentence imposed and/or a conviction. A defendant has 30 days following a decision to appeal.

For projects that are “In Progress”, the Number of Units refers to the number of residential units proposed by the vendor/builder to be included in the project. For projects that are “Completed”, the Number of Units refers to the number of residential units in the completed project enrolled with Tarion. For projects that are “Cancelled”, the Number of Units refers to the number of purchase agreements in a cancelled project.

The Number of Units definition does not change for projects with “Legal Proceeding” listed as part of its status.

Completed: Construction is complete and the condominium corporation for the project has been registered at the Land Registry Office.

Completed – Legal Proceeding: Construction is complete and the condominium corporation for the project has been registered at the Land Registry Office. The vendor/builder or project is currently and/or was previously undergoing a legal proceeding.

In Progress: The vendor/builder is currently selling and/or building the project.

In Progress – Legal Proceeding: The project is in progress. The vendor/builder or project is currently and/or was previously undergoing a legal proceeding.

Cancelled: The vendor/builder has notified purchasers that the project will not be completed.

Cancelled – Legal Proceeding: The project has been cancelled. The vendor/builder or project is currently and/or was previously undergoing a legal proceeding.
